Property rules
All Dockrey Apartments properties are subject to the following landlord's rules
Characters in italic text refer to definitions, acts, and regulations.
Motor Vehicle Act 1989 R.S.,c.293,s.1 hereafter referred to as (MVA)
Protection of Property Act 1989 R.S.,c.363,s.1. hereafter referred to as (PPA)
Residential Tenancies Act 1989 R.S.,c.401,s.1 hereafter referred to as (RTA)
Domestic Violence Intervention Act. 2001, R.S.,c. 29, s. 1. hereafter referred to as (DVIA)
Smoke-free Places Act. 2002 R.S.,c.12.s.1 hereafter referred to as (SFPA)
All regulation definitions and interpretation of the above and all Federal Provincial and Local Laws bylaws and Regulations are confirmed.
Discrimination is unlawful. The intent of this and all other Dockrey Apartments documents is not to discriminate. At all times, any word, phrase, mode of speech, that may be considered specific or exclusive is to be read and interpreted as neutral or inclusive.
Definitions: For the purpose of these rules:

Tenant shall be those residents signatory to the lease
Resident shall include all persons lawfully resident in the property(RTA)
Guest shall include all visitors of any tenant or resident, and any tradesman employed by any tenant or resident, and any person not lawfully a resident (RTA).
Derelict Vehicle shall include any vehicle not currently registered insured and within inspection date for operation on public roads in the province of Nova Scotia.
Off Road Vehicle shall include any vehicle not permitted to be registered for normal operation on public roads in the province of Nova Scotia, and disregarding any registration of the vehicle shall include any boat trailer travel trailer fifth wheel trailer motor home bus or camper.
Notice of breach of rule shall be any written notice by the landlord or his agent delivered in hand, to the mailbox, or under the apartment door of the residence notifying the tenant of any breach of rule.
Proof of delivery shall be the dated signature of the landlord or his agent on the landlord copy of the written notice of breach of rule, or any dated note in the landlord's diary, of the delivery of notice of breach of rule.

Public Safety

  1. The breach of any property "Public Safety" or "Amenity" rule by any tenant resident or guest, shall unless immediately rectified, be grounds to issue a notice to quit RTA.10(7A) (five day notice to quit) to the responsible tenant.
  2. Any second or subsequent breach by any tenant resident or guest of any property "Public Safety" or "Amenity" rule shall be grounds to issue a notice to quit RTA.10(7A) to the responsible tenant.
  3. Tenants are responsible, and liable, for the conduct and actions of all residents and guests.
  4. Guests have no implicit right to enter the property and must leave if asked by the landlord or his agent to vacate the property.
  5. No smoking in any building of the property. Smoking is prohibited within any building and within four meters of any doorway or window. Distance is measured only as a horizontal radius.
  6. No tenant resident or guest may make any alteration to the property or cause any person to make any alteration to the property without the written permission of the landlord or his agent.
  7. Save for resetting of circuit breakers within the individual fuse box for each apartment. No tenant resident or guest may remove, alter, or tamper with any electrical circuit, wiring, switch or control.
    1. Rule 7 above excludes setting of apartment thermostats within their range of adjustment, and includes tampering with thermostats to alter their range of adjustment.
  8. No tenant resident or guest may enter or open, or attempt to enter or open, any furnace, boiler, or oil tank room, electrical panel, telecommunications service panel or any other building service without the written permission of the landlord or his agent.
  9. No tenant resident or guest may remove any safety equipment from the property.
  10. No tenant resident or guest may use safety equipment for any purpose other than its designated purpose.
  11. For the purpose of rules 9 above and rule 10 above any tenant resident or guest who uses, expends or otherwise renders inoperative any safety equipment must inform the landlord or his agent within twenty-four hours, of the use of the equipment.
  12. Waterbeds are not permitted anywhere within the property.
  13. No tenant resident or guest may run inside any building.
  14. No tenant resident or guest may leave any item in any public area.
  15. No tenant resident or guest may represent themselves as the agent of the landlord. At all times the burden of proof shall be on the person claiming to be agent of the landlord.
  16. No Tenant or Resident may sublet, take roommates, boarders, share accommodation or in any way add persons to the tenancy without the written permission of the landlord. All prospective sub-lessees, boarders, roommates, sharers must complete the landlord's application form and satisfy the landlords selection criteria. The safety amenity and comfort of all residents depends on the choice of residents.
  17. For the purpose of rule 16 above, newborn, adopted, and other dependent minor children becoming resident during the tenancy shall be added to the tenancy immediately on notification, and no penalty shall apply if notification to the landlord is delayed.
  18. For the purpose of rule 16 above, adult children of residents wishing to move into the property must complete the landlord's application form and satisfy the landlord's selection criteria, as any other adult.
  19. For the purpose of rule 16 above unauthorized persons living in the apartment shall vacate immediately on order of the landlord or his agent, and a peace bond preventing any further entry shall be sought and enforced against the offender.
  20. No tenant resident or guest shall engage in any unlawful act, anywhere on the property.
  21. No tenant resident or guest shall behave in any manner to cause fear or apprehension to any other resident or guest.
    1. Report of domestic violence is deemed to have caused fear or apprehension to the victim.
  22. Bicycles may not be stored, left, parked in public areas of the property.
  23. No tenant resident or guest may park, stand, wait or otherwise block any fire lane or doorway access with any motor vehicle
  24. All motor vehicles to enter the property must be currently registered insured and inspected.
    1. Derelict vehicles will be removed from the property and may be disposed of without notice, to recover the expense of removal.
    2. Where the disposal of the derelict vehicle does not cover the expense of removal of the derelict vehicle the landlord shall retain the right to recompense of costs, including but not limited to withholding of the damage deposit.
    3. Monies beyond the removal and disposal costs of derelict vehicles shall be placed in trust with the Director of Residential Tenancies to be claimed by the former owner of the derelict vehicle.
  25. No motor vehicle is permitted to drive anywhere on the property except the paved areas.
  26. No Off Road Vehicle may be kept or parked on the property by any resident or guest.
  27. No commercial vehicle (MVA) may enter the property without the permission of the landlord or his agent
    1. Commercial vehicles operated by trades services and contractors engaged by the landlord or his agent, statutory bodies going about their statutory business, and trades and services necessary to the operation of the property have the implicit permission of the landlord.
    2. Permitted commercial vehicles are required to comply with rule 23 above.
    3. Removal trucks must also comply with rule 42 below.
    4. Commercial vehicles property of legal tenants have implicit permission to park on the property, and have no permission to engage in any commercial activity while on the property
  28. Save for the refilling of windscreen washer fluid, No tenant resident or guest may perform any mechanical work, service, or repair to any motor vehicle, or off road vehicle anywhere within the property.

    Pets

  29. At all times pets must be kept entirely within the apartment in secure and healthy conditions appropriate to species.
  30. Residents with pets are responsible for damage caused to all fixtures fittings furniture carpets draperies linens fabrics or any other Dockrey Apartments property by the pet, including and not limited to replacement of any carpet underlay or flooring damaged by urine or feces.
  31. The keeping of pets must comply with rule 21 above.
  32. No venomous animal of any kind may be kept as pet by any tenant or resident or brought to the property by any tenant resident or guest
  33. No noxious animal of any kind may be kept as pet by any tenant or resident or brought to the property by any tenant resident or guest
  34. No insect or arachnid may be kept as pet by any tenant or resident or brought to the property by any tenant resident or guest
  35. Fish or other aquatic animals are permitted as pet with conditions.
    1. The keeping of fish or other aquatic animals must comply with rule 21 above.
    2. Each apartment may have one aquatic tank not larger than fifteen gallons capacity.
    3. Tenants with any aquatic tank larger than one gallon capacity must provide the landlord at all times with current proof of insurance, for all water and consequential damage to the landlord's and all other residents property.
  36. Rodents are permitted as pets with conditions.
    1. The keeping of rodents must comply with rule 21 above.
    2. Each apartment may keep guinea pig(S) or hamster(S) or gerbil(S), entirely within a tank or enclosure designed for the keeping of rodents.
    3. No other Rodent may be kept as a pet
  37. Dogs are permitted as pet with conditions,
    1. The keeping of dogs must comply with rule 21 above.
    2. Only those dogs referred to in the lease or supplemental clause to the lease may be resident in the property at any time.
    3. No tenant may obtain a dog prior to gaining written permission of the landlord
    4. No non-resident dog may be brought to the property by any tenant resident or guest
    5. All dogs must be spayed or neutered and written proof provided to the landlord. In the absence of written proof, the presentation of veterinary ear tattoo, neuter symbol f shall be accepted
    6. The tenant shall keep the dog on leash or long lead, or otherwise under control at all times outside of the apartment. Dogs may not at any time be off leash in public areas of the building or within 12 meters of any doorway.
    7. The tenant shall pooper scoop, or remove fecal matter immediately on deposition
    8. The landlord retains the right, and the tenant acknowledges the right of the landlord, to remove or order to be removed any resident dog at any time
    9. The landlord has absolute discretion to approve or disapprove any application for residence of any dog
    10. Registered guide & hearing dogs are exempted from rule 37c above↑. Written proof of registration to the landlord or his agent is required.
  38. Cats are permitted as pet, with conditions.
    1. The keeping of cats must comply with rule 21 above.
    2. Only those cats referred to in the lease or supplemental clause to the lease may be resident in the property at any time
    3. Cats must be kept entirely inside the apartment, and be litter box trained
    4. All adult cats must be neutered or spayed and written proof provided to the landlord. In the absence of written proof, the presentation of veterinary ear tattoo, neuter symbol f, shall be accepted.
  39. Non-venomous reptiles are permitted with conditions.
    1. The keeping of reptiles must comply with rule 21 above.
    2. Each apartment may keep non-venomous reptiles entirely within a tank or enclosure designed for the keeping of reptiles.
  40. Birds are permitted as pets with conditions.
    1. The keeping of birds must comply with rule 21 above.
    2. Each apartment may keep up to two caged birds entirely within a cage or cages designed for the keeping of birds.

    Amenity

  41. Dockrey Apartments Properties Are Non-Smoking. There is no smoking within any building of any Dockrey Apartments Property, or within four meters of any doorway or window. Distance is measured only as a horizontal radius.
  42. For the purpose of rule 27 above removals trucks are not necessary vehicles and do not have implicit permission to enter the property. Permission must be sought from the landlord or his agent and scheduled around the normal operations of other residents. Permission will not be capriciously withheld; Hours of access for any moving are restricted to lawful daylight hours. At all times removal trucks must comply with rule 23 above
  43. No Tenant resident or guest may use the property for any commercial purpose, business or employment.
  44. No Tenant Resident or guest may open any window during the heating period.
  45. Tenants and Residents must remove their clothes from washers & dryers at the completion of cycle, for the convenience of other residents.
    1. Where a tenant or resident finds another's clothes completed in the washer or dryer they may with due care remove them and place them on the laundry table.
  46. Tenants and Residents must correctly place trash, recyclable & compostable waste in the correct receptacles, in the proper clear or colored bags for the type of waste.
  47. Tenants and Residents shall not have lawn, porch, or street parties anywhere on the property without written permission of the landlord or his agent.
  48. Tenants Residents or guests may not make loud noise after 11pm or before 9am
  49. For the purpose of rule 48 above noise is "loud" if and when any tenant or resident makes any complaint or otherwise requests the noise cease or be diminished
  50. Tenants and Residents must inform the landlord or his agent of any item fixture or fitting within their apartment that requires repair immediately they become aware of the need of repair.
  51. Tenants and Residents must make all attempt to reduce the severity and extent of any damage or breakdown requiring repair.
  52. The landlord or his agent shall acknowledge repair requests, and shall repair health and safety issues immediately. Repairs not related to the health and safety of residents or public safety shall be repaired as soon as possible within normal business practice.
    1. No responsibility can be taken for delays, in the acquisition of replacement parts or by the trades persons necessary to complete repairs, beyond the landlord's control.
